A contractor the state hired began removing the monument around 10:30 p.m. Monday. Its removal comes after the Oklahoma Supreme Court determined the Ten Commandments display violates a constitutional prohibition on the use of public property to support a “system of religion.”

Office of Management and Enterprise Services spokesman John Estus said the state is paying the contractor $4,700 to remove the six-foot-tall sculpture.

Estus said the monument will be taken to a private conservative think tank, the Oklahoma Council of Public Affairs, which has agreed to store it.

Estus said the decision to remove the monument at night was to minimize the distraction to workers in the building and to prevent public demonstrations. source

Something like this would not have been possible 10 years, or even 6 years ago. But with the emergence of Barack Obama in the White House, a dark and sinister spirit has settled in over America. OKLAHOMA SENATE PASSES BILL TO BAN DISMEMBERMENT ABORTIONS TEARING BABIES LIMB TO LIMB

Steven Ertelt, Founder and Editor, Life News — The Oklahoma state Senate has approved a groundbreaking pro-life bill, HB 1721, that would ban dismemberment abortions that tear babies limb from limb. Abortion practitioners would face up to two years in prison under the legislation as well as a $10,000 fine. The pro-life bill now moves to Governor Mary Falin, who is expected to sign it into law.

Both the Senate and state House supported the “Oklahoma Unborn Child Protection from Dismemberment Abortion Act.” House members voted 84-2 for the bill.

If enacted, Oklahoma will become the second state in the nation to protect unborn children from dismemberment abortions that tear them apart limb from limb. Yesterday, Kansas Gov. Sam Brownback signed similar legislation prohibiting dismemberment abortions in the state. Model legislation provided by National Right to Life is also under consideration in the legislatures of Missouri and South Carolina.

“We applaud the Oklahoma legislature for standing up for unborn children by passing the Unborn Child Protection from Dismemberment Abortion Act,” said National Right to Life President Carol Tobias. “This is a transformative law that has the power to change how the public views the gruesome reality of abortion in the United States.”

Dismemberment abortions are as brutal as the partial-birth abortion method, which is now illegal in the United States, Tobias said.

“The Oklahoma legislature is to be commended for protecting unborn children and prohibiting this barbaric inhumanity,” said Oklahomans For Life State Chairman Tony Lauinger.

“Dismemberment abortion kills a baby by tearing her apart limb from limb,” said National Right to Life Director of State Legislation Mary Spaulding Balch, J.D. “Before the first trimester ends, the unborn child has a beating heart, brain waves, and every organ system in place. Dismemberment abortions occur after the baby has reached these milestones.”

But would such an abortion ban be constitutional given the Roe v. Wade decision? The group points to the high court’s ruling in the partial-birth abortion case as grounds for banning dismemberment abortions too.

In his dissent to the U.S. Supreme Court’s 2000 Stenberg v. Carhart decision, Justice Kennedy observed that in D&E dismemberment abortions, “The fetus, in many cases, dies just as a human adult or child would: It bleeds to death as it is torn limb from limb. The fetus can be alive at the beginning of the dismemberment process and can survive for a time while its limbs are being torn off.” Justice Kennedy added in the Court’s 2007 opinion, Gonzales v. Carhart, which upheld the ban on partial-birth abortion, that D&E abortions are “laden with the power to devalue human life…”

“When abortion textbooks describe in cold, explicit detail exactly how to kill a human being by ripping off arms and legs piece by piece, civilized members of society have no choice but to stand up and demand a change,” added Spaulding Balch. “When you think it can’t be uglier, the abortion industry continues to shock with violent methods of abortion.”

Theodore Shoebat, Shoebat Foundation — The police department of Tulsa, Oklahoma, suspended a police officer, Capt. Paul Fields, for refusing to attend a mosque service which was organized by Muslims as a law enforcement appreciation event hosted by the Islamic Society of Tulsa.

Although this happened in 2010, the The 10th U.S. Circuit of Appeals just ruled on Thursday that the “police officer’s constitutional rights were not violated”. In 2012, Capt. Fields was denied by a judge from filing a complaint against the department. Fields said that his religious rights were violated because he was punished even after “he was told to either attend or order subordinates to attend a law enforcement appreciation event hosted by the Islamic Society of Tulsa.”

This is what the court concluded as what they filed on Thursday:

The Attendance Order did not burden Fields’s religious rights because it did not require him to violate his personal religious beliefs by attending the event; he could have obeyed the order by ordering others to attend, and he has not contended on appeal that he had informed his supervisors that doing so would have violated his religious beliefs.

The order did not violate the Establishment Clause because no informed, reasonable observer would have perceived the order or the event as a government endorsement of Islam.

The order did not burden Fields’s right of association because it did not interfere with his right to decide what organizations to join as a member.

Fields’ equal-protection claim duplicates his free-exercise claim and fails for the same reason.

The district court did not abuse its discretion in denying Fields’s motion to amend the complaint to add ORFA and free-speech retaliation claims because the amendment would have been futile.

NTEB News Desk, May 2, 2014 — The statue is a direct response to the state’s installation of a Ten Commandments monument outside the Capitol in 2012. State Representative Mike Ritze paid for the controversial statue with his own money, and therefore it was considered a donation and OK to place on government property. Following that line of reasoning, the Satanic Temple submitted a formal application for their monument.

As Trait Thompson of the Oklahoma Capitol Preservation Commission told CNN last December, “Individuals and groups are free to apply to place a monument or statue or artwork.” The applications are then approved or rejected by the Commission. Unfortunately, the state has placed a halt on issuing permits for any other monuments until a lawsuit filed by the ACLU against Ritze’s Commandments monument is settled.

Nonetheless, the Satanists are building this thing, and I was offered an early peek at the work in progress by Temple spokesperson Lucien Greaves. Greaves told me he has received numerous threats from people who want to attack the sculpture, but that he “wouldn’t expect these outraged and nearly insensible reactionaries to actually know how to assault a bronze monument without severely hurting themselves in the process.” Still, he’s not taking any chances. The Temple is building a mold of the sculpture so they can pop these things out like evil, terribly expensive action figures whenever they need a new one.

“Depending on our insurance policy,” Greaves said, “we may be able to cast two from the destruction of one, expediting our arrival to the next battleground.”

The idea of a Satanic monument sitting on government property in Oklahoma—which is like the Bible Belt’s Bible Belt—seems a bit far-fetched, but Greaves says that “there has been quite a bit of discussion among legal scholars who recognize how difficult it would actually be for Oklahoma to turn us down… Constitutional law is quite clear on this issue: The state can’t discriminate against viewpoints. If they’ve opened the door for one, they’ve opened it for all.”

Ryan Kiesel from the Oklahoma ACLU seems to agree. He told the Libertarian Republic, “If, at the end of the day, the Ten Commandments monument is allowed to remain on the Capitol grounds with its overtly Christian message, then the Satanic Temple’s proposal can’t be rejected because it is of a different religious viewpoint.” Temple estimates that the monument will be finished in a few months. Once it’s done, they plan to put it in front of the Oklahoma Statehouse regardless of the the Capitol Preservation Commission’s ongoing battle against the ACLU. They feel this should be allowed because their application was submitted before all the hullabaloo over Ritze’s monument.

“After all,” Greaves told me, “the Ten Commandments still stand at the State Capitol. We are fully willing to place our monument at the Capitol, even while the ACLU suit is fought, with the understanding that a judgment against the Ten Commandments will have ramifications for our monument as well, likely resulting in the removal of both.” source – Vice.com
