DEATH PANELS: SENATE BILL WOULD USE TAX DOLLARS TO HAVE DOCTORS COUNSEL FOR DEATH



ANOTHER DANGEROUS PROVISION OF THE LAW WOULD HAVE THE EFFECT OF INVALIDATING STRONG
PATIENT-CENTERED PROTECTIVE LAWS

Burke J. Balch, J.D., LifeNews — Last week, U.S. Senators Mark R. Warner (D-Va.) and Johnny Isakson (R-Ga.) introduced S. 1549, the Care Planning Act of 2015, to use federal tax dollars to pay health care professionals to counsel older people in deciding whether to accept or reject life-preserving medical treatment, food and fluids.

On its face, S. 1549 purports to promote neutral, fully informed “advance care planning” that will assist patients to implement their own values in legally valid directives. Unfortunately, however, there is abundant evidence, documented in the March 2015 NRLC report “The Bias Against Life-Preserving Treatment in Advance Care Planning,” that a combination of cost pressures and the ideological commitment of a significant number of health care providers to hastening death for those deemed to have a “poor quality of life” would in practice lead to many federally funded advance care planning sessions being used to exercise subtle – or not-so-subtle – pressure to agree to reject life-preserving treatment.

Entities conducting such programs openly boast of how much money they have saved insurance companies by inducing patients to reject expensive life-saving medical treatment. Advocates believe it will save Medicare money as well.

The pervasive focus of the Institute of Medicine September 2014 report “Dying in America” is summed up in its statement, “Because most people who participate in effective advance care planning choose maximizing independence and quality of life over living longer, advance care planning can potentially save health care costs . . . .” (What this statement effectively means is that the Institute of Medicine report authors expect that “most people” receiving advance care planning counseling will come to agree they would rather die than live with dependence or a poor quality of life, and therefore will agree to forego expensive treatment that could preserve their lives when they are “not worth living.”)

If advance care planning sessions were to be federally funded as proposed by the Care Planning Act of 2015, then no matter how emphatically the bill language calls for balance, accuracy, and respect for individual patients’ values and wishes, there could be no sufficient safeguard to ensure that federal tax dollars subsidize only planning for the use or rejection of life-preserving measures that is conducted in a truly neutral way. There is no realistic way adequately to monitor such care planning sessions among patients and health care personnel in what would necessarily be private and confidential interactions.

National Right to Life, along with many others, supports the use of advance directives by which individuals may indicate their wishes regarding medical treatment should they become incapable of making health care decisions; indeed, it makes available “Will to Live” versions for every state at www.nrlc.org/medethics/willtolive/.

It has made clear that it is willing to work with Members of Congress to implement measures to develop aids to advance care planning with sufficient safeguards to ensure they provide fully informed consent and are not structured to dissuade those using them from choosing life-preserving measures. However, National Right to Life opposes S. 1549 since without proper safeguards, advance care planning can be and is already being used to nudge patients to reject life-saving treatment they would otherwise want both to cut costs, and also due to a pervasive “quality of life” ethic.

During the debate over the enactment of Obamacare, there was considerable controversy over the inclusion in an early version of the bill of funding for health care providers to be paid to conduct “advance care planning” for patients under Medicare. That provision was not included in the ultimately enacted legislation because of an outcry by those who feared it would be used to push people into agreeing to forego expensive health care. S. 1549, revives this provision as a free-standing bill. Subsequent developments should intensify, rather than calm, the well-founded fears of older people and those with disabilities that in practice government-funded and promoted planning sessions are likely to be less about actually discovering and applying their own wishes than about nudging them to accept premature deaths.

In addition to creating pro-life concerns over nudging patients to reject treatment, S. 1549 contains a very dangerous provision that would in effect authorize health care providers who believe it immoral to preserve the lives of those with a poor quality of life to deny life-preserving treatment against the express will of a patient or surrogate. Unfortunately, in both medical literature and increasing practice, moral and ethical convictions are frequently cited to justify involuntary denial of life-saving treatment, and even assisted food and fluids, against patients’ wishes.

Another dangerous provision of the law would have the effect of invalidating strong patient-centered protective laws. A section of S. 1549 says that when someone does not have an advance directive in the state in which he or she is a patient, documents that may have been filled out in other states are to be implemented. This provision would override any state laws that ensure informed consent to the rejection of life-saving measures. Thus, for example, it would invalidate an Oklahoma law that requires that people are cannot be starved or dehydrated if they did not explicitly say that is what he/she wished.

The National Right to Life Committee is urging that Senators be contacted by their constituents asking them to oppose S. 1549, the Care Planning Act of 2015.

There Are Actually ‘Death Panels’

On Today’s Broadcast (September 30, 2014): Guest Colin Gunn is an award winning writer, director, and film producer. Many have been impacted by his documentary, "Indoctrination" which investigates public schools and the decline of Christianity.

Colin has now produced a new documentary on health care entitled, 'Wait Till It’s Free', that takes a hard look at how we do health care in America. He proposes to let Capitalism and the Free Market System work and keep health care affordable, not political programs like Obamacare.

Colin says that if you follow the money, you will discover why health care is so expensive, and who is making the money in today's flawed system. Hospitals are the biggest culprit:

--Bills are inflated artificially, because the government will subsidize the unpaid portion of the patient's bill.

--Those without insurance may be charged more for a procedure--or stay in the hospital longer--than those with insurance.

--Actual costs for services are often obscured or disguised on the bills, making it nearly impossible to determine whether the bills are accurate or reasonable. By contrast, the free market prices of other types of services are very transparent.

'Medicare' and 'Medicaid' have been significant steps toward socialized medicine, as the government intrudes more and more into the health care industry. Insurance in principle is not wrong, but with the government forcing people to pay for things such as abortion, people of faith are required to pay for things they don't agree with or don't need--thus increasing the cost.



Despite official denials, there are actually 'death panels' which will play an important role in the full implementation of Obamacare. Obamacare is a program that promotes the idea that one plan fits all. Thus young men and senior citizens are forced to pay for pregnancy care.

Many jobs have been lost due to the employer mandate, because employers cannot afford to pay for employees' health care benefits.

Colin calls the American doctor a 'victim.' Many doctors are looking to retire early, because the government intrusion is forcing prices up and requiring much additional paperwork, but the doctor's income does not increase and may actually go down. Thus doctors must absorb the extra costs.

It is also becoming much more difficult to get new doctors licensed. He compared the socialized health care system in the UK and Scotland with that in America. The U.S. seems to be headed for this same kind of 'single payer system.'

Colin does present a solution for our health care crisis in the last part of his documentary.

Michael Snyder, The Economic Collapse — This Memorial Day, Barack Obama and members of Congress will honor our veterans by wearing ribbons and laying wreaths, but what they should really do is apologize to the entire nation for treating them like human trash for the past five years. You see, the truth is that this VA scandal is nothing new. The problems at the VA hospitals have been documented over and over again for years. When Barack Obama was a U.S. senator, he served on the Veterans Affairs Committee. So as he entered the White House, he was supposed to be an expert in this area. And back in 2008, he pledged to "make the VA a leader of national health care reform so that veterans get the best care possible". But of course that never happened. And now Obama is claiming that he only learned of the "secret waiting lists" at VA hospitals by "watching television", and his staff says that he is "madder than hell" about it. So now that he has been publicly shamed, will Obama actually do something about it? Because our military veterans deserve far better care than what they have been getting.

Most Americans don't realize this, but members of al-Qaeda detained at Guantanamo Bay actually receive far better medical treatment than our military veterans do. Just consider what former Pentagon spokesperson J.D. Gordon had to say about the matter...
Doctors and medical personnel are at their beck and call. Got a cold, a fever, a toothache, a tumor, chest or back pain, mental health issues, PTSD? No problem, come right on in. Military doctors are waiting to see you.

The VA and Gitmo eligible patient-to-health care provider ratios speak volumes.

While the Gitmo ratio is 1.5 to 1, for America’s 9 million veterans receiving VA health care and 267,930 VA employees, the ratio is 35 to 1.
Because there are not nearly enough doctors for our veterans, many of them end up waiting for months just to get an appointment with one. It was CNN that blew the lid off this story when they reported that at least 40 military vets had died while waiting for appointments in the Phoenix area...
At least 40 U.S. veterans died waiting for appointments at the Phoenix Veterans Affairs Health Care system, many of whom were placed on a secret waiting list.

The secret list was part of an elaborate scheme designed by Veterans Affairs managers in Phoenix who were trying to hide that 1,400 to 1,600 sick veterans were forced to wait months to see a doctor, according to a recently retired top VA doctor and several high-level sources.

For six months, CNN has been reporting on extended delays in health care appointments suffered by veterans across the country and who died while waiting for appointments and care. But the new revelations about the Phoenix VA are perhaps the most disturbing and striking to come to light thus far.
CNN was reporting on this for months, but Obama only learned about this just recently?

Considering that he is the chief executive of the entire system, how in the world is that possible?

And of course this has not just been happening in Phoenix. The following is an excerpt from a news story about a vet that died in Houston while waiting for the VA system to take care of him...
George Barraza love two things in this life: playing the electric guitar with all his heart and this country.

During the Vietnam War, Barraza proudly served in the U.S. Army.

But on April 16, Barraza, a father of three girls, a chef and an American veteran, died waiting for an appointment at the VA Medical Center in Houston.

At the time of his death, Barraza was battling heart disease, high blood pressure, diabetes, cirrhosis of the liver and liver cancer. But his problems became much worse in September when he went to the Michael Debakey VA Medical Center in terrible pain and unable to move his hands at all.

"They said, 'Oh, that looks like it hurts, let me give you some pain medication and send you on home,'" said Barraza's daughter, Georgia Barraza who complains the VA staff did not treat her father's problem that day by admitting him and caring for him, but instead gave him pain medication and an appointment to come back.

And here is an example from Seattle...
Donald Douglass had a small spot on his forehead when he went to the Seattle Veterans Affairs hospital in 2011.

A biopsy confirmed it was cancerous. But it was four months before the hospital scheduled an appointment for him to have it removed — and by then, it had spread, wrapping around a facial nerve and eventually getting into his blood.

The delay proved fatal, his lawyer said — and it mirrors concerns being raised about the VA system nationally.
In fact, veteran deaths like this have been documented all over the nation. After sacrificing so much, our vets are being horribly neglected.

It is a national disgrace.

And of course the problems go far beyond waiting times. For example, down in Miami illegal drug dealing is rampant at VA facilities...
When asked why he would risk his job and speak publicly, Detective Thomas Fiore considered the question carefully before answering.

“People are dying,” he finally said, “and there are so many things that are going on there that people need to know about.”

Fiore, a criminal investigator for the VA police department in South Florida, contacted CBS4 News hoping to shed light on what he considers a culture of cover-ups and bureaucratic neglect. Among his charges: Drug dealing on the hospital grounds is a daily occurrence.

“Anything from your standard prescription drugs like OxyContin, Vicodin, Percocet, and of course marijuana, cocaine, heroin, I’ve come across them all,” he explained.
And what one whistleblower at a VA hospital in North Carolina says is going on is beyond repulsive...
The whistleblower, who wishes to remain anonymous for obvious reasons, works at a large 250 acre VA hospital in North Carolina. He presented his credentials to us which checked out. The VA employee lifted the lid on a number of shocking details during an interview with Sgt. Joe Biggs.

“Recently there’s been a very rapid race to move records, boxes, change labels, whatever it may be, they’re putting them in rooms that nobody would look in….and there’s multiple times that I have seen in the past week or so them moving boxes….so apparently they’re hiding their tracks somewhere,” stated the VA employee, adding that the activity preceded an inspection of the facility, suggesting it was part of an effort to conceal evidence in the aftermath of the secret waiting list scandal.

Even more chilling was a warning sent out to VA employees at the facility which, according to the whistleblower, was meant to get across the message, “Do you see what happens to the people that try to get things straight around here, they’re not here anymore,” a tone the whistleblower described as “pretty telling.”

The employee also revealed the shocking attitude of one supervisor at the hospital towards older veterans, who asserted that older vets “should be taken outside and shot in the head because they’re worthless.” The individual still works at the hospital and was not disciplined for his comments.
What is happening to this nation?

How can we treat our military veterans like this?

The respect for veterans has gotten so low in this country that sometimes it takes more than a year  to bury their dead bodies...
The bodies of 28 veterans at the L.A. County Morgue were finally moved Friday for burial to the Riverside National Cemetery.

CBS2/KCAL9 pressed the L.A. County Coroner’s Office Thursday to find out why the bodies had not yet received a proper burial after a source indicated there may have been as many as 60 veterans at the morgue for the past year and a half.

The morgue says the bodies were unclaimed and they don’t know how long the veterans were there.

The law states veterans are supposed to receive a proper burial.
Barack Obama is acting like all of this is a huge surprise to him.

Even though he worked on these issues as a U.S. Senator, and even though he has been the top executive in charge of the system for five years, he claims complete ignorance about what has been going on.

I find this very hard to believe.

The truth is that the news media has been reporting about these kinds of abuses for ages.

And personally, I have been writing about these things for years. Here are some examples...





So how is it possible that so many people could have been talking about these things for so many years and yet Obama knew nothing?

Come on.

The truth is that Obama does not want to take any responsibility for this scandal or any other scandal.

He wants to continue to be a teflon politician that nothing ever sticks to.

But now he has absolutely no excuse for not taking action.

Military veterans are dying right now, and they need medical attention.

Hopefully Obama will step up to the plate and do the right thing.

Bob Unruh, WND — Talk-radio host Rush Limbaugh on Monday blasted the Veterans Administration as a “death panel being done on purpose” as the investigation into secret waiting lists and backlogs causing unnecessary deaths expanded to 19 states.

“These people are special. These are soldiers. They’re special. They got wounded in action … defending this country on missions assigned by their commander-in-chief and other commanding officers,” Limbaugh said.

“Now we learn of these deaths by attrition, secret waiting lists, and this is the real bad thing of it. People on these lists assume that they’re being moved ahead of the line. That’s the purpose of the secret list, that they’re going to really be taken care of. Because the backlog is so jammed, the line for treatment at the VA is so long that they’ve come up with this secret list business, and the people on that list think that they’re essentially being moved to the top of the class, or the head of the line, in front of the line. And they’re just being ignored,” he said.

He said it appears the death toll, combining various reports, has passed 100 victims.

“It’s simply unconscionable. So you have to ask, the natural assumption is that nobody wants these people to die, even if you add the death panel component, nobody wants these people to die, yet they are. At the very least what we’re dealing with here is a total inability to deal with this. And at worst it’s the death panel being done on purpose.”

He said he knows some people won’t recognize the death panel aspect, “even though the evidence is pretty clear.”

“When you have government employees receiving salary bonuses for ostensibly saving money by virtue of shrinking the number of people on the list, how does that happen? How do people end up off the list and not treated? They pass away. And if you’re gonna have government employees bonused on that basis, then you would be not that far out of whack to assume there might be some death panel at work here,” he said.

“If you don’t want to go that far, at the very least, there is rampant incompetence here and inability to run the medical treatment of the Veterans Affairs system,” said Limbaugh.

He said it’s a projection of what Obamacare will be like for everyone eventually, because the government is unable to run health care.

“There are people dying. If you don’t want to believe the death panels are the reason, then you’ve gotta believe it’s incompetence. But you can’t just say, ‘Well, you know, excrement happens.’ ‘Cause you could be the excrement next time,” he said.

He continued the conversation with a caller, who explained the failed VA system is the kind of “single-payer” system sought by many progressives.

“Sarah Palin was mocked for bringing up death panels,” the caller said. “Well, folks, this is it. You have 40 dead veterans whose cause of death is the system that they were in. It wasn’t because of just their diseases. They were caught in a system, a single-payer system that viewed them as a cost. Not as a veteran, not as a human, but as a cost.”

Dean has pointed out health care will have to be rationed under Obamacare as decisions are made about who will receive critical care and life-saving treatments.

Doug Book of the Western Center for Journalism notes that under Obamacare, Oregon set up a Health Authority that is promoting a guideline stating “treatment with intent to prolong survival is not a covered service for patients who have progressive metastatic cancer and are not able (in the view of the physician) to be helped.”

“Palliative care is all that will be provided.”

At one point Obama even undermined his own party’s claims. In 2009, he told a daughter whose 104-year-old mother still was enjoying life five years after getting a pacemaker that her mother should have just been given a pain pill.

WND reported Bobby Schindler of the Terri Schiavo Life & Hope Network said ethics panels and medical facility boards for some time now have been getting involved in decisions about who lives and who dies, based on their illness, needs, treatment, expenses and resources.

Congressman: ‘What’s Happening In VA Hospitals
Is What Will Happen With Obamacare’

The problem is so extensive, veterans have coined a slogan to describe the government claims process: “Delay, deny, wait till I die.” Millions in Obamacare bonuses then awarded?

Greg Corombos, WND Radio — Rep. Louie Gohmert, R-Texas, is appalled at reports that at least 40 U.S. veterans died after being included on a secret list to delay them needed medical treatment, and he said disgraceful practices like this could have been stopped long ago if care of U.S. veterans mattered more to President Obama.

The comments come days after the Phoenix Veterans Affairs Health Care system was found to be keeping 1,400-1,600 veterans on a secret list to have their care delayed. Forty of them died. Three hospital administrators are currently on paid leave as an investigation proceeds.

Gohmert is not accusing the Obama administration of playing a role in the actual creation of any lists to delay care, but he believes Obama deserves a lot of the blame.

“It is clear there is a systemic problem with the Veterans Administration, and it didn’t just all of a sudden crop up under this president,” Gohmert said. “President Bush started making some inroads, and this president has made some efforts. The fact is, the buck does stop with the top commander over all of our armed forces and over all executive branch activities.”

The congressman said the president makes it very clear which issues matter most to him, and health care for vets doesn’t appear to be very high on the list.

“If the president wanted to make this as much of a central issue as he has this ‘climate-change’ issue – which allows the government to take over more people’s property and their rights and their lives – then we’d get the VA fixed very quickly,” Gohmert said.

On Tuesday, the White House released a new climate-change report, warning that its findings “underscore the need for urgent action to combat the threats from climate change, protect American citizens and communities today, and build a sustainable future for our kids and grandkids.” Obama has launched a broad national campaign this week to publicize the report.

But Gohmert said, “Apparently this climate change was global freezing back in the 1970s, then global warming and then, when it quit warming, now it’s climate change. That apparently is a much bigger issue to this administration than helping those who laid down their lives and put themselves in danger for the good of the country.”

Two major veterans organizations, including the American Legion, and several Senate Republican leaders are calling for Veterans Affairs Secretary Eric Shinseki to resign. Other veterans groups disagree. Gohmert said he reluctantly agrees that it’s time for a change.

“I think that Gen. Shinseki has tried to do an appropriate job. I know he cares about veterans. But when you have a team that is just performing poorly across the board, except for a few exceptions, then I think it’s time to get a new coach. It’s time for him to step down and get somebody in who will have the free rein to get the VA running as it should and not just as another Obamacare facility,” said Gohmert, who reiterated previous comments suggesting the bureaucratic nightmare unfolding at the VA is a preview of what we can all expect through the new health-care law.

“Some in America say we don’t have to worry about repealing Obamacare because socialized medicine falls of its own weight,” he said. “But that’s not true. Socialized medicine never falls of its own weight. You see, what’s happening in the VA is what will happen to any socialized medicine system, and it’s what will happen with Obamacare: more and more government takeover. The way it avoids going broke is you put people on lists the way the VA does. So it doesn’t go broke. You just don’t give them the treatment they need if you don’t have the funding and the backing.

“Therefore, you have people dying waiting to get the treatment they need or having to live in horrible pain because they can’t get a hip replacement or a knee replacement. They have a terrible quality of life because they can’t get the help they need. But the system doesn’t go broke; it just puts more Americans either at risk of death or at risk of misery while they’re living. That’s why we need to reform health care, but we need to get rid of Obamacare once and for all.”

There Department of Veterans Affairs says there are 589,767 claims currently in the VA claims inventory, and 308,285 veterans claims currently backlogged in the system. Each claim averages between 146 and 265 days to complete.

The problem is so extensive, veterans have coined a slogan to describe the government claims process: “Delay, deny, wait till I die.”


So what is Gohmert’s short-term solution for veterans being denied care?

He said more choices is a great place to start.

Gohmert said, “If we got a majority of veterans to say, ‘I’d rather just have a card that says I’m a veteran and I can walk into any clinic and any hospital and get the care,’ then that would probably be the best thing to do for our veterans.” » Full Article

On Wednesday, CNN released a shocking report that at least 40 veterans died while waiting for treatment from the Phoenix Veterans Affairs Health Care system. The CNN report suggests the Phoenix VA used a “secret list” to stage a cover-up of the long wait times that ultimately led to a loss of life. Congress has now called for an investigation into the “extremely disturbing allegations.” On radio this morning, Glenn discussed the latest example of how we have failed to provide the necessary care and support for our veterans.

And I did something called a ‘Rally for America,’” Glenn said. “It was, ‘Listen: If we’re going to do this, we have to promise each other right now we’re going to fight it with everything we have. And then when we come home we’re not going to spit on them. We’re going to take care of them. I refuse to be the 1960s generation.’ Well, guys, we are becoming the 60s generation.”

According to the CNN report, the ‘secret list’ is an “elaborate scheme” to hide from the federal government the fact that nearly 1,600 ailing veterans have been forced to wait for months on end for medical attention.

“The scheme was deliberately put in place to avoid the VA’s own internal rules,” Sam Foote, a retired doctor who spent 24 years working for the Phoenix VA hospital, told CNN, adding that the list is the invention of hospital management. “They developed the secret waiting list.”

There are two lists that the Phoenix VA uses for patient appointments, the retired doctor said. There’s an “official list,” which shows that veterans are being provided timely and effective medical care. And there’s the “secret” list, which accurately reflects the fact that veterans are being forced to wait months for care.

Glenn and Pat agreed this is America’s first look at the death panel system that many warned of before the passage of Obamacare in 2010.

“This is government-run health care,” Pat said of the VA. “So this is the way your death panel works. ‘This is going to hurt our stats as a hospital. So let’s put these guys on a separate list so it doesn’t hurt our staff.’ And that’s what they’re alleging is that there’s some kind of secret list.”

Glenn explained that now more than ever it is essential we find ways to provide care and support for our veterans. Glenn has spoken openly about the treatment his is receiving at the Carrick Brain Center in Dallas, and the work that private organization is doing to help as many people as possible.

“We have to dedicate ourselves to help these guys because nobody else is doing it… Read the story on TheBlaze about the veteran that just can’t get an appointment… It’s the Canadian healthcare system, except this one is intentional,” Glenn concluded. “How much money are we giving away to the rest of the world?
