REAGAN JUDGE SIDES WITH WICCANS TO REMOVE TEN COMMANDMENTS FROM CITY PROPERTY

(Bloomfield, New Mexico) A judge nominated by then-President Ronald Reagan has sided with two New Mexico Wiccans and has ordered that a Ten Commandments monument must be removed from city property because it endorses Christianity.

U.S. District Judge James A. Parker issued his ruling on Thursday, stating that the 3,000-pound monument violated the First Amendment to the U.S. Constitution as it constituted a government “establishment of religion.”

“In view of the circumstances surrounding the context, history, and purpose of the Ten Commandments monument, it is clear that the City of Bloomfield has violated the Establishment Clause because its conduct in authorizing the continued display of the monument on City property has had the primary or principal effect of endorsing religion,” he wrote.

The monument had been erected in 2011 following a resolution allowing private citizens to place historical displays at Bloomfield City Hall. A former city council member had proposed the monument four years prior, which was then approved by city council but paid for with private money.

“Presented to the people of San Juan County by private citizens recognizing the significance of these laws on our nation’s history,” the monument read, which was unveiled during a special ceremony on Independence Day 2011.

But Wiccans Jane Felix and Buford Coone of the Order of the Cauldron of the Sage felt offended by the monument and contacted the American Civil Liberties Union (ACLU) for assistance.

“Our clients who are not Christians, they took issue with this and it made them feel alienated from their community,” Alexandra Smith, legal director for the American Civil Liberties Union (ACLU) of New Mexico, told local television station KRQE.

The organization filed a lawsuit against the city in 2012, asserting that the monument’s presence on government property amounts to the government endorsement of religion. While the city argued before the court that the monument was historical in nature, the ACLU contended that the content of the Commandments themselves is blatantly religious.

“One of the commandments is thou shalt put no gods before me. This is clearly not a historical document, but is in fact religious doctrine,” Smith stated.

On Thursday, Parker agreed and ordered that the monument be removed by September 1oth, pending appeal.

Mayor Scott Eckstein told the Farmington Daily Times that he was disappointed in the outcome of the decision.

“I am surprised and had never really considered the judge ruling against it because it’s a historical document just like the Declaration of Independence and the Bill of Rights,” he stated. “The intent from the beginning was that the lawn was going to be used for historical purposes, and that’s what the council voted on.”

The city hall lawn also features monuments to the Declaration of Independence, Lincoln’s Gettysburg Address and the Bill of Rights.

The Bloomfield city attorney is now considering whether to file an appeal in the matter.

New Mexico Court of Appeal Judge:
“States Can Demand Christians Violate Their Faith”

WND EXCLUSIVE — The U.S. Supreme Court delivered evidence to the American people Monday that they should fear their own government.

That’s according to the Alliance Defending Freedom, which fought all the way to the highest court to protect a New Mexico photographer’s freedoms of speech, conscience and religion.

Ultimately, however, the life-tenured justices refused to hear the case, allowing to stand a decision that effectively allows government to force individuals to promote messages they oppose, ADF said.

“Only unjust laws separate what people say from what they believe,” said ADF Senior Counsel Jordan Lorence. “The First Amendment protects our freedom to speak or not speak on any issue without fear of punishment.”

The dispute arose after photographer Elaine Huguenin declined a job to commemorate the same-sex union of two lesbians.

The women filed a complaint with the New Mexico Human Rights Commission, which charged Huguenin and her business partner, husband Jon, with violating the state’s “sexual orientation” law. The commission ordered the Huguenins to pay more than $6,000 in attorney fees to the couple, even though the two women found someone else to photograph their ceremony. A New Mexico trial court, the New Mexico Court of Appeals and the state Supreme Court upheld the ruling.

On Monday, the U.S. Supreme court allowed the decision to stand.

Lorence said ADF had hoped the Supreme Court “would use this case to affirm this basic constitutional principle; however, the court will likely have several more opportunities to do just that in other cases of ours that are working their way through the court system.”

ADF Senior Counsel David Cortman said Americans “oppose unjust laws that strong-arm citizens to express ideas against their will.”

“Elaine and numerous others like her around the country have been more than willing to serve any and all customers, but they are not willing to promote any and all messages,” he said. “A government that forces any American to create a message contrary to her own convictions is a government every American should fear.”

ADF said that while the punishment handed out in the New Mexico case is now permanent, there are other cases that likely will push the justices into making determinations on what the government can force Christians to say or do.

According to ADF, other cases in the legal pipeline that could reach the U.S. Supreme Court include:
Ingersoll v. Arlene’s Flowers: A long-time customer and friend of florist Baronelle Stutzman sued her because she could not in good conscience use her creative skills to beautify his same-sex ceremony. Both he, through his ACLU attorneys, and the Washington state attorney general have filed lawsuits against Stutzman in both her professional and personal capacities for unlawful “discrimination,” even though she has served and employed people who identify as homosexual and numerous other florists are willing to do the work.

Craig v. Masterpiece Cakeshop: Two men filed a legal complaint against Colorado cake artist Jack Phillips after he declined to use his artistic talents to create and decorate a cake for a same-sex ceremony. Although many other cake artists are willing to do the work, and Phillips told the men that he would be willing to make them any other type of baked good, the men nonetheless filed discrimination complaints against him through their ACLU attorneys.

Baker v. Hands On Originals: The Gay and Lesbian Services Organization filed a legal complaint against a Kentucky T-shirt printer for declining to produce shirts that promote its “pride festival.” Managing owner Blaine Adamson of Hands On Originals told GLSO he would gladly refer them to another shop that would do the work for the same price. GLSO easily found someone to produce the shirts for free. In addition, Hands On Originals both serves and employs people who identify as homosexual. Nonetheless, the complaint alleges that the printer is guilty of “discrimination.”
The New Mexico case began in 2006 when Elaine Huguenin received an email from a woman, Vanessa Willock, asking if she would be “open to helping us celebrate our day,” a “commitment ceremony” between her and her same-sex partner.

When Huguenin politely declined because the ceremony was at odds with her beliefs, ADF said, Willock found another photographer, for less money.

Nevertheless, Willock pursued a complaint with the New Mexico Human Rights Commission, demanding Huguenin be punished.

The commission ruled against Huguenin, ordering her to pay $6,637.94 in attorneys’ fees to Willock. The case then made its way through the New Mexico state court system, and the New Mexico Supreme Court upheld the ruling.

One of the state Supreme Court justices said that being ordered to compromise one’s beliefs is simply the “price of citizenship.”

WND reported when the state court, including judges Edward Chavez, Petra Jimenez Maes, Charles Daniels, Barbara Vigil and Richard Bosson, ruled against the photographer, because she has the option of going out of business.

The judges stated:
At its heart, this case teaches that at some point in our lives all of us must compromise, if only a little, to accommodate the contrasting values of others. A multicultural, pluralistic society, one of our nation’s strengths, demands no less. The Huguenins are free to think, to say, to believe, as they wish; they may pray to the God of their choice and follow those commandments in their personal lives wherever they lead. The Constitution protects the Huguenins in that respect and much more. But there is a price, one that we all have to pay somewhere in our civic life.

In the smaller, more focused world of the marketplace, of commerce, of public accommodation, the Huguenins have to channel their conduct, not their beliefs, so as to leave space for other Americans who believe something different. That compromise is part of the glue that holds us together as a nation, the tolerance that lubricates the varied moving parts of us as a people. That sense of respect we owe others, whether or not we believe as they do, illuminates this country, setting it apart from the discord that afflicts much of the rest of the world. In short, I would say to the Huguenins, with the utmost respect: it is the price of citizenship.

‘YOU COULD NEVER ANTICIPATE THIS HAPPENING IN THE UNITED STATES OF AMERICA’



“It’s A Nightmare, It’s Unfathomable”



Jason Howerton, TheBlaze — What began as a simple traffic stop ended in a humiliating and nightmarish ordeal for a New Mexico man. It won’t come as a surprise to most people why the man has now filed a federal civil rights lawsuit.

The incident began on Jan. 2 as David Eckert was leaving the local Walmart in Deming, N.M. He reportedly failed to make a complete stop at a stop sign, prompting police to pull him over.

The officers asked him to step out of the vehicle and claim the man appeared to be clenching his buttocks, Eckert’s attorney, Shannon Kennedy, told TheBlaze. It is unclear why police removed him from the vehicle in the first place. However, because the cops believed he was clenching his buttocks, they took it as reason to suspect him of hiding narcotics in his anal cavity.

Police officers detained Eckert after a narcotics sniffing dog allegedly issued a “hit” on Eckert’s car seat. Meanwhile, they sought a search warrant for an anal cavity search.

“What is so strange about this case is they held him with no evidence,” Kennedy said. “They seized him to collect evidence, to go on a fishing expedition on someone’s body.”

Upon securing the warrant, Deming police officers took the man to an emergency room, but hit their first snag when a doctor refused to perform the anal cavity search because he believed it to be “unethical.”

So police tried again at the Gila Regional Medical Center in Silver City, N.M., where doctors agreed to the search.

KOB-TV outlined the disturbing series of events that occurred next, details confirmed by medical records and official documents provided to TheBlaze by Eckert’s attorney:
1. Eckert’s abdominal area was X-rayed; no narcotics were found.

2. Doctors then performed an exam of Eckert’s anus with their fingers; no narcotics were found.

3. Doctors performed a second exam of Eckert’s anus with their fingers; no narcotics were found.

4. Doctors penetrated Eckert’s anus to insert an enema. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

5. Doctors penetrated Eckert’s anus to insert an enema a second time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

6. Doctors penetrated Eckert’s anus to insert an enema a third time. Eckert was forced to defecate in front of doctors and police officers. Eckert watched as doctors searched his stool. No narcotics were found.

7. Doctors then X-rayed Eckert again; no narcotics were found.

8. Doctors prepared Eckert for surgery, sedated him, and then performed a colonoscopy where a scope with a camera was inserted into Eckert’s anus, rectum, colon and large intestines. No narcotics were found.
Kennedy told TheBlaze these are undisputed facts from medical records, not claims made by her client.

As he was being detained and probed, Kennedy said Eckert never gave doctors his consent to perform the procedures and protested his treatment, which all arose from the simple traffic violation.

The entire ordeal lasted for roughly 12 hours.

TheBlaze has reached out to the Deming Police Department. This story will be updated should the department respond.

“It’s a nightmare, its unfathomable. You could never anticipate this happening in the United States of America,” Kennedy said, adding that in 18 years of practicing civil rights law, “this may be the most egregious case I have ever seen with law enforcement abuse.”

Kennedy also said the search warrant — in which there were legal concerns anyway — was carried out illegally because it was only valid in Luna County, N.M. The anal cavity search and other procedures were performed at the Gila Regional Medical Center, in Grant County.

Further, she said the search warrant was only good through 10 p.m., but medical records show the preparation for the colonoscopy started at 1 a.m. the next morning. In theory, even if the search warrant were completely legal and compliant, it was no longer valid.

Eckert is suing the city of Deming and Deming police officers Bobby Orosco, Robert Chavez and officer Hernandez. He is also suing Hidalgo County deputies David Arredondo, Robert Rodriquez and Patrick Green; Deputy District Attorney Daniel Dougherty and the Gila Regional Medical Center, including Robert Wilcox, M.D. and Okay Odocha, M.D.
