‘Search and Seizure’

The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, SHALL NOT BE VIOLATED, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

On July 12 of this year an opinion piece was written in the Wall Street Journal entitled, 'Smart Cities Will Know Everything About You.' This sounds like everyone's personal privacy is at risk. Just how far have we come?

‘Reminiscent Of The Treachery We Witnessed Under The Nazi Rregime’

Bob Unruh, WND — Americans’ telephone conversations already are being monitored by the National Security Agency and their health-care policies by the Internal Revenue Service. Now there’s “Truthy,” a government-funded project at Indiana University that will watch their Tweets for “political smears” and “social pollution.”

The goal is to track those comments.

The Washington Free Beacon reported this week that the government already has contributed nearly $1 million to the project that its organizers say is to “analyze and visualize the diffusion of information on Twitter.”

“The Truthy system evaluates thousands of tweets an hour to identify new and emerging bursts of activity around memes of various flavors. The data and statistics provided by Truthy are designed to aid in the study of social epidemics: How do memes propagate through the Twittersphere? What causes a burst of popularity?”

The program operators say: “We also plan to use Truthy to detect political smears, astroturfing, misinformation, and other social pollution. While the vast majority of memes arise in a perfectly organic manner, driven by the complex mechanisms of life on the Web, some are engineered by the shady machinery of high-profile congressional campaigns. Truthy uses a sophisticated combination of text and data mining, social network analysis, and complex networks models. To train our algorithms, we leverage crowdsourcing: we rely on users like you to flag injections of forged grass-roots activity. Therefore, click on the Truthy button when you see a suspicious meme.”

John Whitehead, president of the Rutherford Institute and author of “A Government of Wolves: The Emerging American Police State,” said it’s a step beyond what the U.S. Constitution allows.

“For the federal government to be tracking so-called hate speech or subversive propaganda is not only Orwellian but violates the very fundamental rights to free speech and privacy guaranteed to us by the Constitution,” he told WND. “Under such a program, the Founding Fathers would have been under surveillance and probably rounded up for opposing the British government.

“Moreover, encouraging fellow citizens to inform on each other is reminiscent of the treachery we witnessed under the Nazi regime where people were arrested for merely raising questions about government actions. This is clearly an illegitimate use of taxpayer monies.”

The National Science Foundation-funded program aims to “mitigate the diffusion of false and misleading ideas, detect hate speech and subversive propaganda, and assist in the preservation of open debate,” according to records of the project.

The Free Beacon reported that while “Truthy” claims to be non-partisan, the project’s lead investigator, Filippo Menczer, supports numerous progressive advocacy groups, including President Obama’s Organizing for Action, Moveon.org, Greenpeace, the Sierra Club, Amnesty International and True Majority.

Menczer teaches at the university and links to those groups from his biography at the Center for Complex Networks and Systems Research, the report said.

The concept of “hate speech” has been used as a political weapon since before Obama became president. But it was his signature that made law the federal “hate crimes” act, which applies special penalties based on person’s beliefs and feelings.

WND reported “hate crimes” and “hate speech” were targeted by two Democratic lawmakers when the Justice Department submitted a report for action against any Internet sites, broadcast, cable television or radio shows determined to advocate or encourage “violent acts.”

Among the organizations that previously have been labeled as “haters” are the World Congress of Families, which promotes the “natural family,” the Drudge Report for covering “black crime” and Joseph Farah, WND founder and CEO, who long has been targeted by Southern Poverty Law Center which has described WND as “the conspiracist ‘news’ site.”

Sen. Ed Markey, D-Mass., and Rep. Hakeem Jeffries, D-N.Y., believe their Hate Crime Reporting Act of 2014 “would create an updated comprehensive report examining the role of the Internet and other telecommunications in encouraging hate crimes based on gender, race, religion, ethnicity, or sexual orientation and create recommendations to address such crimes,” stated a news release from Markey’s office.

The Alliance Defending Freedom has called such “hate-crimes” bills “another nail in the coffin of the First Amendment.”

“All violent crimes are hate crimes, and all crime victims deserve equal justice,” ADF Senior Legal Counsel Erik Stanley said in a statement. “This law is a grave threat to the First Amendment because it provides special penalties based on what people think, feel or believe.”

CAIR Targeting Townspeople For Opposing
Major Islamic Construction Project

WND EXCLUSIVE — A Muslim organization is targeting seven Michigan residents who opposed plans for a major Islamic construction project in their neighborhood, and a legal team defending them alleges that the goal is to intimidate the project opponents and send a message to others.

The American Freedom Law Center is representing the opponents, whose names were withheld to protect their privacy.

A variety of subpoenas for information, including private emails and other documents, had been delivered by the Council on American-Islamic Relations.

Robert Muise, AFLC senior counsel, said, “There is no doubt that CAIR – a Shariah-adherent Islamist group that notoriously uses the legal system to silence any opposition to its nefarious agenda – is abusing the discovery process to retaliate against and intimidate private citizens who dared to publicly express their opposition to the Islamic center.”

Muise said AFLC “is quite familiar with CAIR’s bullying tactics, which is why it is important that we defend these private citizens’ constitutional rights.”

CAIR touts itself as a Muslim civil rights group, but federal prosecutors in 2007 named the Washington, D.C.-based group an unindicted co-conspirator in a plot to fund the Palestinian terrorist organization Hamas, and more than a dozen CAIR leaders have been charged or convicted of terrorism-related crimes.

The case was prompted by a plan by the Muslim Community Association of Ann Arbor in 2012 to build an Islamic school and community center.

It needed the town to rezone the property. But the request was denied because of infrastructure and traffic concerns.

CAIR filed a federal civil rights action against the township on behalf of MCA, claiming the denial of the rezoning application violated the Muslims’ rights.

AFLC explained that the township residents were concerned about the traffic congestion that would be caused by the construction of a school and community center in their neighborhood. They circulated and submitted to township officials a petition expressing their opposition to the rezoning, and several of them spoke out at public hearings.

“As a result, CAIR served harassing subpoenas on a number of these citizens, demanding that they produce private emails and other documents, and in some cases, appear for a deposition,” AFLC said.

David Yerushalmi, AFLC co-founder, said CAIR’s discovery demands “plainly infringe upon precious First Amendment liberties and the paramount right of a private citizen to publicly express her opinions to elected representatives on matters that affect her and her community.”

“On a broader level, CAIR’s decision to browbeat these ordinary Americans clearly shows the pervasiveness of Shariah-adherent Islam and its ‘civilizational jihad’ within our borders,” he said.

“Needless to say, if CAIR wishes to persecute Americans through the legal system, they’ll have to contend with us.”

FBI wiretap evidence from the Hamas-funding case showed CAIR Executive Director Nihad Awad was at an October 1993 meeting of Hamas leaders and activists in Philadelphia. CAIR, according to the evidence, was born out of a need to give a “media twinkle” to the Muslim leaders’ agenda of supporting violent jihad abroad while slowly institutionalizing Islamic law in the U.S.

As WND reported in 2010, a federal judge later determined that the Justice Department provided “ample evidence” to designate CAIR as an unindicted terrorist co-conspirator, affirming the Muslim group has been involved in “a conspiracy to support Hamas.”

Government agencies tell us we can run, but we can't hide! Thanks to a whistleblower -- Edward Snowden, a 29-year-old former CIA employee and National Security Agency contractor -- startling revelations have been made about the NSA's comprehensive surveillance program called PRISM. Corporations such as Google, Facebook, Skype, YouTube, Microsoft, Yahoo, AOL, Apple, and PalTalk are allegedly "Current Providers" of said "Surveillance and Stored Comms" that include (but varies by provider) the following: email, chat (IM, video and voice), videos, photos, stored data, VoIP, file transfers, video conferencing, notifications of target activity (logins, etc.), Social Networking Details, and of course Special Requests.

"The existence of this NSA data analysis program was revealed when The Guardian newspaper obtained a court order that directed Verizon Communications to turn over to the NSA the "metadata" records of millions of callers. Call metadata includes information that can identify the devices being used to complete the call, phone numbers and other session data, including information that can be used to determine the location of the callers. The PRISM program has been around since 2007, thanks to provisions under the Foreign Intelligence Surveillance Act (FISA)."

Of course, several of these major organizations deny involvement in providing detailed information on everyday citizens without search warrants.

"Microsoft, Google and Apple have all denied involvement in the PRISM program, with Apple claiming they do not provide any government agency with direct access to their servers, and any government agency requesting customer data must get a court order. A Facebook statement said when the company is asked for data or information about specific individuals, it provides information only to the extent required by law."

Another Setback For Justice’s
Defense Of Massive Spying Program

Garth Kant, WND — (WASHINGTON) “I just denied your motion to dismiss,” U.S. District Court Judge Richard Leon told Department of Justice attorney Marcia Berman.

“Do you understand that?” he asked, speaking slowly and deliberately, as though to a child.

The judge appeared frequently perplexed by Berman’s explanations Monday afternoon in the federal courtroom as to why the government was not prepared to argue its case after filing a motion three weeks ago asking him to halt further proceedings while appeals go forward in the nation’s biggest spy case.

Leon had already ruled in December that the National Security Agency had probably violated Americans’ Fourth Amendment rights against unreasonable search and seizure with its PRISM program.

Monday, the two sides in the case were to argue over whether the NSA had also violated First Amendment rights to free speech and Fifth Amendment rights to due process.

The plaintiff’s attorney, Larry Klayman, announced Monday he has filed a request with the U.S. Supreme Court, asking it to leap-frog the appeals court and decide for itself the question of whether the NSA violated Fourth Amendment rights. Additionally, Klayman agreed last week to drop Verizon as a defendant.

The government attorneys apparently took those developments to mean they would not have to argue the remaining constitutional issues Monday, those involving possible violations of the First and Fifth Amendments.

After the seemingly astonished judge informed Berman that he was denying the government’s motion for dismissal of the case, he chided her that the government had put itself in position where it could be declared in default.

Leon then slowly and deliberately asked the Justice Department attorney, “So, when are you going to answer the complaint?”

Berman said Monday, and Leon accepted that.

Adding to the somewhat unusual circumstances of the trial was the fact the defense table was crowded with five Justice Department attorneys and one from Verizon, while Klayman sat all alone at the plaintiff’s table.

That did not seem to perturb Klayman, who told WND he is confident he will win “because the American people are on our side.”

He said Leon essentially told the government to “quit dragging your heels, and get the show on the road.”

Klayman said the government is employing delaying tactics in the hope events overtake the proceedings.

In December, when Leon ruled the NSA’s mass collection of phone data was probably unconstitutional, he ordered the agency to stop collecting such data on Klayman and Charles Strange, the father of a Navy SEAL killed in action in Afghanistan.

Leon ruled that the Foreign Intelligence Surveillance Act, or FISA, contains no language expressly barring any third-party challenges to FISA court orders. That meant that Klayman’s clients had standing to bring such a lawsuit and dispute the constitutionality of the NSA spying program, something the government disputes. That’s when Leon also ruled the government had likely violated the Fourth Amendment’s prohibition on unreasonable searches and seizures.

Klayman’s lawsuit was filed after former NSA contractor Edward Snowden revealed a FISA court order that allowed the government, under a provision of the Patriot Act, to require Verizon to provide data on all calls made on its networks within the U.S. and between the U.S. and a foreign country.

Klayman has also filed class-action claims on behalf of all U.S. citizens who are Verizon subscribers, saying the government has violated their First, Fourth and Fifth Amendment rights.

He previously told WND, “This is a further attempt to keep information about the biggest violation of the Constitution in American history from the American people. It’s an outrage,” he said.

He said the Obama administration has the perspective of “heads I win, tails you lose,” and its attitude is “we control all the information and the American people be damned. They don’t have rights.”

“It’s important for the American people to see how the government treats them and views them. We’re nothing more than rabble,” he said.

The government’s motion argued: “further litigation of plaintiffs’ challenges to the conduct of these programs could well risk or require disclosure of highly sensitive information about the intelligence sources and methods involved – information that the government determined was not appropriate for declassification when it publicly disclosed certain facts about these programs.”

But in court on Monday, Klayman argued that there are many ways the government could provide him access to NSA information needed for the trial without endangering national security, including conducting all such proceedings in private with a judge or government official presiding.

The attorney said he had done that previously, with a CIA employee monitoring the information he learned while pursuing a case about possible Chinese spying.

The Justice Department had argued that if the trial proceeded, “Further litigation of this issue could risk or require disclosure of classified national security information, such as whether plaintiffs were the targets of or subject to NSA intelligence-gathering activities, confirmation or denial of the identities of the telecommunications service providers from which NSA has obtained information about individuals’ communications, and other classified information.”

But that’s exactly the point of his lawsuits, Klayman said. They were filed to find out the details of the programs and whether the government, in its alleged pursuit of information about terror activities, has been violating the constitutional assurances of Americans’ privacy. » Full Article

Obama Characteristically Derisive And Obstructive, Providing Little Resolution Regarding His Administration’s Numerous Scandals

B. Christopher Agee, The Western Center For Journalism — To his credit, Barack Obama agreed to a very rare interview with an unsympathetic journalist Sunday, sitting down with Fox News host Bill O’Reilly just prior to the Super Bowl kickoff.

In typical fashion, though, the dialogue devolved into an exercise in blame and conjecture on the part of Obama. He responded to an inquiry regarding the ongoing IRS scandal by suggesting O’Reilly and his network are the real culprits.

“I mean these kinds of things keep surfacing,” he said, “in part because you and your TV station will promote them.”

While he ultimately conceded that “some bone-headed decisions” were made at low levels of the agency, he denied that there was “even a smidgen of corruption.”

O’Reilly also asked about the bungled rollout of ObamaCare and its enrollment website, HealthCare.gov.

“We all anticipated there would be glitches,” Obama explained, though he said he doesn’t think “anybody anticipated the degree of problems” associated with the site’s implementation.

Obama attempted to change the subject when the host directly asked why he refused to fire Health and Human Services Sec. Kathleen Sebelius in the aftermath of the botched rollout.

“My main priority is making sure it delivers for the American people,” he said.

O’Reilly interjected that Obama is “not holding her accountable,” prompting the president to further equivocate.

“When we’re midstream,” he said, “we want to make sure our main focus is how do we make this thing work so people are able to sign up.”

Obama refused to admit his false assertion that Americans would be able to keep their insurance constituted his biggest error, concluding O’Reilly has “a long list of my mistakes in my presidency.”

Obama also used the interview as an opportunity to shift blame away from the administration regarding the deadly 2012 attack in Benghazi, Libya.

“We revealed to the American people exactly what we understood at the time,” he claimed, suggesting he jumped to action by addressing security concerns that led to the violent outbreak.

“The key,” he said, “is that we’ve implemented the reforms that have been recommended.”

O’Reilly asked many of the questions millions of Americans have wanted answers to for years. Unfortunately, Obama was characteristically derisive and obstructive, providing little resolution regarding his administration’s numerous scandals. » Full Article
