SUPREME AFTERMATH TROUBLE IS COMING

One month ago, 5 lawyers on the Supreme Court created a constitutional right to so-called same-sex marriage. The four that dissented in essence were issuing a warning that trouble is coming. The result? Religious liberty is under attack.

Joining Jim to discuss this was Mat Staver. Mat is the founder and chairman of Liberty Counsel, an international nonprofit, litigation, education and policy organization dedicated to advancing religious freedom, the sanctity of life and the family.

Mat began by commenting on undercover video footage featuring a high-level Planned Parenthood representative. The organization is now backtracking to try and explain comments that point to the alleged practice of dissection and body parts trafficking. Mat believes they should not only be defunded at the state and federal levels but criminal prosecution charges should be brought about as well.

The first Monday after June 26th, county clerks were on the firing line because they were to provide same-sex marriage licenses. He described one instance in Kentucky where the ACLU is not only asking the clerk to issue the licenses, but for her to face punitive, monetary damages.

Mat also described the plight of David Wells. Dave is an ordained minister and volunteer in the Kentucky Department of Juvenile Justice. He had his volunteer credentials revoked because he wouldn't sign a statement promising to refrain from ever telling any of the juvenile inmates that homosexuality is sinful.

Discussion then moved to Wisconsin Senator Tammy Baldwin who explained in comments on MSNBC that the 1st Amendment right to observe deeply held religious beliefs doesn't extend far beyond one's institution of faith. In other words, you can believe in one-man, one-woman marriage while in your church, just don't express that outside in public life.

Mat responded by noting that this shows her ignorance of the 1st Amendment and the free exercise of religion. He went on to explain that the 1st Amendment applies not only to churches and synagogues but to individuals as well. In fact, the 1st Amendment protects the individual from the government should they want to intrude on the free exercise of religion.

This Crosstalk also looked at the call for churches throughout America to lose their tax exempt status due to the Supreme Court ruling;

The religious capitulation taking place nationwide;

The University of California's offering of six choices for gender identity;

Downtown Reno replaced the American flag with the LGBT pride flag;

Executive action by the President to expand the 1964 Civil Rights Act to include LGBT individuals and more.

Then, when they refuse to violate their faith, they are fined $135,000 and driven into bankruptcy. Lastly, when they are interviewed about it the judge then slaps a “cease and desist” order on them so they cannot talk about why they could not bake the lesbian wedding cake. Oregon Labor Commissioner Brad Avakian finalized a preliminary ruling today ordering Aaron and Melissa Klein, the bakers who refused to make a cake for a same-sex wedding, to pay $135,000 in emotional damages to the couple they denied service.

Oregon Labor Commissioner Brad Avakian finalized a preliminary ruling today ordering Aaron and Melissa Klein, the bakers who refused to make a cake for a same-sex wedding, to pay $135,000 in emotional damages to the couple they denied service.

“This case is not about a wedding cake or a marriage,” Avakian wrote. “It is about a business’s refusal to serve someone because of their sexual orientation. Under Oregon law, that is illegal.”

In the ruling, Avakian placed an effective gag order on the Kleins, ordering them to “cease and desist” from speaking publicly about not wanting to bake cakes for same-sex weddings based on their Christian beliefs.

The cease and desist came about after Aaron and Melissa Klein participated in an interview with Family Research Council’s Tony Perkins. During the interview, Aaron said among other things, “This fight is not over. We will continue to stand strong.”

Lawyers for plaintiffs, Rachel and Laurel Bowman-Cryer, argued that in making this statement, the Kleins violated an Oregon law banning people from acting on behalf of a place of public accommodation (in this case, the place would be the Klein’s’ former bakery) to communicate anything to the effect that the place of public accommodation would discriminate.

Administrative Law Judge Alan McCullough, who is employed by the Oregon Bureau of Labor and Industries and was appointed by Avakian, threw out the argument in the “proposed order” he issued back in April.

BUT TODAY, AVAKIAN, WHO WAS IN CHARGE OF MAKING THE FINAL RULING IN THE CASE—AND IS ALSO AN ELECTED POLITICIAN—REVERSED THAT DECISION

“The Commissioner of the Bureau of Labor and Industries hereby orders [Aaron and Melissa Klein] to cease and desist from publishing, circulating, issuing or displaying, or causing to be published … any communication to the effect that any of the accommodations … will be refused, withheld from or denied to, or that any discrimination be made against, any person on account of their sexual orientation,” Avakian wrote.

Hans von Spakovsky, a senior legal fellow at The Heritage Foundation, called the order “outrageous” and said citizens of Oregon should be “ashamed.”

“This order is an outrageous abuse of the rights of the Kleins to freely practice their religion under the First Amendment,” he said.

And Commissioner Avakian’s order that the Kleins stop speaking about this case is even more outrageous—and also a fundamental violation of their right to free speech under the First Amendment.

Avakian would have fit right in as a bureaucrat in the Soviet Union or Red China. Oregon should be ashamed that such an unprincipled, scurrilous individual is a government official in the state.

The case began in February 2013 when Rachel and Laurel Bowman-Cryer filed a complaint against the Kleins for refusing to bake them a wedding cake. At the time of the refusal, same-sex marriage had not yet been legalized in Oregon.

The Bowman-Cryers’ complaint went to the Oregon Bureau of Labor and Industries, which is in charge of defending the law that prohibits businesses from refusing service to customers based on their sexual orientation, among other characteristics, called the Equality Act of 2007.

In January 2014, the agency found the Kleins unlawfully discriminated against the couple because of their sexual orientation. In April, McCullough recommended they pay $75,000 to Rachel and $60,000 to Laurel.

In order to reach the total amount, $135,000, Rachel and Laurel submitted a long list of alleged physical, emotional and mental damages they claim to have experienced as a result of the Kleins’ unlawful conduct.

Examples of symptoms included “acute loss of confidence,” “doubt,” “excessive sleep,” “felt mentally raped, dirty and shameful,” “high blood pressure,” “impaired digestion,” “loss of appetite,” “migraine headaches,” “pale and sick at home after work,” “resumption of smoking habit,” “shock” “stunned,” “surprise,” “uncertainty,” “weight gain” and “worry.”

In their Facebook post, the Kleins signaled their intention to appeal Avakian’s ruling, writing, “We will not give up this fight and we will not be silenced,” already perhaps putting themselves at risk of violating the cease and desist. source

THEY WANT TO USE ‘HATE SPEECH LAWS’ TO DESTROY FREEDOM OF SPEECH IN AMERICA

LAWS AIM TO WIPE OUT ANY ALTERNATIVE VOICE TO THE LGBT AGENDA (AND ISLAM)

By Michael Snyder, End Of The American Dream — Hate speech laws are going in all around the world, and progressive activists in the United States want to use these kinds of laws to destroy free speech in America. You see, the truth is that these hate speech laws that are being implemented all over the planet are not just about preventing speech that promotes violence or genocide against a particular group of people. Instead, these laws are written in such a way that anyone that says something that “offends” or “insults” someone else is guilty of “hate speech”. Even if you never intended to offend anyone and you had no idea that your words were insulting, in some countries you can be detained without bail and sentenced to years in prison for such speech. Today, there are highly restrictive hate speech laws in Canada, in Mexico and in virtually every single European nation. The United States is still an exception, but the truth is that our liberties and freedoms are being eroded every single day, and it is only a matter of time until “hate speech laws” are used to take away our freedom of speech too.

If you don’t think that this could ever happen in America, you should consider what the American Bar Association has to say on the matter. This is the national organization that represents all of our lawyers, judges, etc. So when the ABA speaks on legal matters, it carries a significant amount of weight. The following is how the American Bar Association defines “hate speech”
Hate speech is speech that offends, threatens, or insults groups, based on race, color, religion, national origin, sexual orientation, disability, or other traits.
Did you catch that?

If I say something that offends or insults you, there is a very good chance that I have just committed “hate speech” according to the ABA.

And support for these kinds of laws is growing. In fact, one survey found that 51 percent of all Democrats now support hate speech laws. It is only a matter of time before progressives start pushing for them in a big way.

Sadly, many of these progressives don’t even understand that our Constitution protects free speech. Just consider what CNN anchor Chris Cuomo recently had to say about this
Hate speech is not the same thing as free speech, wrote CNN anchor Chris Cuomo on the ultimate forum for public discourse: Twitter.

Amid debate about free speech after a shooting at an anti-Muslim protest in Texas , a user tweeted at Cuomo: “Too many people are trying to say hate speech (doesn’t equal) free speech.”

In response, Cuomo, who has a law degree, said, “It doesn’t. Hate speech is excluded from protection. Don’t just say you love the Constitution … read it.”
No, I think that it is Cuomo that needs to read the Constitution. The fact that he gets to deliver “the news” to millions upon millions of Americans is absolutely frightening.

But without a doubt, we do need to have a conversation about “hate speech” in the United States. If I offend or insult you, that does not mean that I “hate” you. And if I disagree with you, that does not mean that I “hate” you either.

Some of the things that are considered to be “offensive speech” these days are absolutely ridiculous. For example, just consider the following excerpt from a recent article by Paul Joseph Watson
Here’s an actual list of things that according to the University of Wisconsin are racist:

Asking someone where they are from or where they were born.

Telling someone they speak good English.

Telling someone that you have several black friends.

Saying that you’re not a racist.

Complimenting an Asian person by telling them they are very articulate.

Asking an Asian person for help with science or math.

Uttering the phrase “There is only one race, the human race.”

Saying that you think America is a melting pot and that when you look at someone you don’t see race.

Believing that the most qualified person, regardless of race, should get the job.

Thinking that every person, regardless of race, can succeed in society if they work hard enough.

Telling a black person who is being too loud to be quiet.

Telling an Asian or Latino person who is too quiet to speak up.

Mistaking a person of color for a staff member when you’re in a store.

Calling something “gay”.

Doing an impression of someone’s dialect or accent.
Could you imagine going to prison for any of those “offenses”?

But this is where our country is heading if we don’t stand up for our rights.

Right now, the progressives are on a roll. In the wake of the recent Supreme Court decision on same sex marriage, some progressives are already talking about going after the tax exemptions of churches that oppose it. In fact, the New York Times recently published an article entitled “Now’s the Time To End Tax Exemptions for Religious Institutions”.

But of course the ultimate goal is far more insidious. In the end, they want to shut down all speech that offends them in any way
The American Unity Fund is a heavily funded new super-PAC looking to blanket the country with LGBT anti-discrimination laws. In effect, those laws aim to wipe out any alternative voice to the LGBT agenda. The effort is being spearheaded by billionaire hedge fund manager Paul Singer and another wealthy hedge fund manager, Tim Gill. Gill’s operations—the Gill Foundation and Gill Action—have been dedicated to “nonpartisan” gains for the LGBT lobby on the legislative and judicial fronts.
Those that do not believe that this could ever possibly happen in “the land of the free” should consider what has already happened in our neighbor to the north
Anyone who is offended by something you have said or written can make a complaint to the Human Rights Commissions and Tribunals. In Canada, these organizations police speech, penalizing citizens for any expression deemed in opposition to particular sexual behaviors or protected groups identified under ‘sexual orientation.’ It takes only one complaint against a person to be brought before the tribunal, costing the defendant tens of thousands of dollars in legal fees. The commissions have the power to enter private residences and remove all items pertinent to their investigations, checking for hate speech.
Of course the same kind of thing is already happening over in Europe as well. For instance, one Christian pastor in Northern Ireland is being prosecuted for calling Islam “a doctrine spawned in hell”
An evangelical pastor in Northern Ireland is under fire and will be prosecuted after calling Islam “satanic” and claiming that its doctrine was “spawned in hell” during a controversial 2014 sermon that streamed over the Internet.

Pastor James McConnell, 78, of Whitewell Metropolitan Tabernacle in Belfast, Northern Ireland, made his comments — which included calling Islam “heathen” — in a sermon delivered last May, the BBC reported.

“The Muslim religion was created many hundreds of years after Christ. Muhammad, the Islam Prophet, was born around the year A.D. 570, but Muslims believe that Islam is the true religion,” he preached. “Now, people say there are good Muslims in Britain. That may be so, but I don’t trust them.”

McConnell continued, “Islam’s ideas about God, about humanity, about salvation are vastly different from the teaching of the holy scriptures. Islam is heathen. Islam is satanic. Islam is a doctrine spawned in hell.”
Once such laws are in place in the United States, it won’t be difficult for the government to find you if you are committing “hate speech”. As I have written about repeatedly, the U.S. government already monitors virtually everything that is said and done on the Internet. The following is an excerpt from an article that was recently authored by Micah Lee, Glenn Greenwald, and Morgan Marquis-Boire
The sheer quantity of communications that XKEYSCORE processes, filters and queries is stunning. Around the world, when a person gets online to do anything — write an email, post to a social network, browse the web or play a video game — there’s a decent chance that the Internet traffic her device sends and receives is getting collected and processed by one of XKEYSCORE’s hundreds of servers scattered across the globe.

In order to make sense of such a massive and steady flow of information, analysts working for the National Security Agency, as well as partner spy agencies, have written thousands of snippets of code to detect different types of traffic and extract useful information from each type, according to documents dating up to 2013. For example, the system automatically detects if a given piece of traffic is an email. If it is, the system tags if it’s from Yahoo or Gmail, if it contains an airline itinerary, if it’s encrypted with PGP, or if the sender’s language is set to Arabic, along with myriad other details.
And as I wrote about yesterday, western governments are already using paid trolls to identify and combat “extremists” on social media websites such as YouTube, Facebook and Twitter.

We are rapidly becoming a “Big Brother” society, and if we don’t stand up for our freedoms and liberties now, it is inevitable that we will eventually lose just about all of them.

Unfortunately, most of the population is absolutely clueless about all of this. In fact, as Mark Dice demonstrated the other day, many Americans don’t even know what we are celebrating on the 4th of July. As a society, we have become extremely “dumbed down”, and we have lost connection to the values and principles that this country was founded upon.

Todd Starnes, Fox News & Commentary — The men, believed to be radicalized roommates from Phoenix, tried to launch an attack on a gathering of freedom-lovers in of all places – the Lone Star State. It would turn out to be a most unfortunate decision.

It turned out those practicing their First Amendment rights were protected by those practicing their Second Amendment rights. Within a matter of moments – the jihadists were quickly dispatched to the Hereafter thanks to a straight-shooting traffic cop.

Authorities have yet to categorize it as a terrorist attack, but one thing is clear. Police thwarted what could have been an unprecedented massacre on American soil.

The intended target was a contest for cartoons depicting the Prophet Muhammad, hosted by the American Freedom Defense Initiative. Among the speakers were AFDI president Pamela Geller and Geert Wilders, a Dutch lawmaker known for his criticism of radical Islam.

Now, you may not agree with Miss Geller's tactics. Some might accuse her of poking a bear – and that may very well be true.

But Miss Geller does have Constitutional right to poke the bear. She does have a Constitutional right to free speech. And those who disagree with her have a Constitutional right to disagree.

But they do not have a constitutional right to gun down those who might say or write or draw something that disparages the Prophet Muhammad.

And we should be alarmed at the growing number of pundits and talking heads who are blaming Miss Geller for the attempted terrorist attack.

“Free speech aside, why would anyone do something as provocative as hosting a ‘Muhammad drawing contest,’” New York Times reporter Rukmini Callimachi tweeted.


And yet, the New York Times had no problems with the
“Piss Christ” art exhibit – that’s the one where a crucifix
was submerged in a jar of urine. The website Newsbusters
called the Times’ hypocrisy a “double-standard.”


“Freedom of speech does not extend to insulting the Messenger Muhammad (saw) & hence provoking the anger of ¼ of the world,” tweeted British political activist Anjem Choudary.

He went on to call Geller and Wilders and the American Freedom Defense Initiative “enemies of Islam and Muslims.”

Fox News contributor Katie Pavlich rightly called Choudary an “enemy to human kind.” Amen, sister.

The idea that Ms. Geller is somehow responsible for what happened is absurd.

“The gunmen are fighting against freedom of speech,” she told "Fox & Friends." “The First Amendment protects all speech – not just ideas that we like – but most particularly political speech. Who would decide what is good and what is forbidden? The Islamic State? Muslim Brotherhood groups? This is the key issue of our age.”

Aside from a brief mention in a press gaggle, the White House has been curiously quiet about the attack. Louisiana Gov. Bobby Jindal called on the president to publicly condemn “radical Islam.”

“The truth of the matter is that even though President Obama will not admit it – Islam has a problem, and it is called radical Islam,” Jindal said in a statement. “And the proponents of radical Islam hate our First Amendment, they hate freedom of speech and they want to destroy it and us.”

Jindal also called on Muslim leaders to condemn the violence. He said it’s time for them to step up and “declare that perpetrators of such violence are the enemy, they are wrong, and they will not be rewarded in the afterlife.”

The cold hard reality is that we don’t know how many more radicalized Muslims might be living among us – waiting to wage jihad. Wilders sounded the alarm last week in Washington, D.C.

“I’m warning America,” he said. “Don’t think that what’s happening in Europe today, will not happen in America tomorrow – because it will.”

And it did.

THE NEW ‘GAY RIGHT’ NOT TO BE OFFENDED DOES NOT TRUMP THE FIRST AMENDMENT

Liberals overplay their hand. It's part of the deficiency. Whether real or perceived, if the pagan left can rationalize a sense of "progress" on some freedom-killing cause du jour, then it'll push, push, push until it falls flat on its face.

Step aside, America. Give them room.

Religious liberty is non-negotiable. Freedom of conscience is the bedrock of American society. Today’s anti-Christian lynch mob, which angrily imagines that some newfangled gay right to not be offended trumps the First Amendment, is not only on the wrong side of the U.S. Constitution, it’s on the wrong side of history.

It’s also on the wrong side of public opinion.

Bloomberg reporter Dave Weigel gets it. That is, he gets it to the extent that any mainstream media-type can get anything. Weigel is a liberal. Despite this affliction, he recently admitted that Religious Freedom Restoration Acts like the one signed into law by Bill Clinton in 1993 and those introduced in Indiana, Arkansas and dozens of other states are, media propaganda notwithstanding, popular with the American people.

In his April 1 Bloomberg article, headlined, "Democrats Turn Against Religious Freedom Laws. Voters Don't Agree With Them," Weigel laments that, "in panic about the backlash over the Religious Freedom Restoration Act, Democrats are settling in as the party that opposes religious liberty laws."

"[I]t's now expected for Democrats to denounce RFRAs, just as large corporations are denouncing them," he continues. "In doing so, all of the critics are on the wrong side of public polling. According to a March edition of the Marist poll, 54 percent of Americans agreed with 'allowing First Amendment religious liberty protection or exemptions for faith-based organizations and individuals even when it conflicts with government laws.' By a 2-point margin, 47-45, even a plurality of Democratic voters agreed with that.

"The margins were even larger in opposition to laws that proposed 'penalties or fines for individuals who refuse to provide wedding-related services to same-sex couples even if their refusal is based on their religious beliefs," adds Weigel. "[A]ccording to Marist, Americans oppose penalties on businesses ... by a 65-31 margin. The margin among Democrats: 62-34 against."

It remains unclear whether Weigel intended to draw a distinction between Americans and Democrats, but the anti-Christian penalties and fines to which he refers – the very ones Americans reject by a 2-to-1 margin—are even now being levied by left-wing "human rights" Star Chambers with increasing frequency and intensity against Christian bakers, florists, innkeepers, caterers, photographers and a litany of other small-business owners from coast to coast. This, not because these Christian individuals won't "serve gays" (they will and do without hesitation), but, rather, because they politely decline to spend their time and talent contributing to, and thereby endorsing the message behind, specific events that run counter to biblical principles and otherwise infringe their deeply held religious convictions.

You know, the First Amendment.

It’s the Constitution, stupid.

Even so, I say keep it up. With each overt instance of anti-Christian bigotry, discrimination and persecution, public sympathy and support for religious liberty mounts. It also undercuts the withering LGBT-whatchits’ “We’re-all-a-bunch-of-victims! blather. In fact, there is evidence suggesting that this systematic anti-Christian hostility is souring the public on gay marriage altogether.

Still, if there's one thing the non-fascist majority hates more than freedom trampling, it's blatant hypocrisy. "The dispute is illustrated in Colorado, where a Christian baker, Jack Phillips, is defending himself in court for declining to bake a cake for a same-sex ceremony," reports WND.

"And at the same time, Colorado's Civil Rights Commission ruled that 'cake artists' at Azucar Bakery, Gateaux and Le Bakery Sensual were perfectly justified in refusing to bake cakes that 'violated their conscience.'"

In an apparent (and successful) effort to prove a point, a clever Christian activist sued these pro-"gay" bakers for refusing to create, at his request, Bible-shaped cakes with scriptural references to homosexual sin. What's good for the Christian goose is evidently not good for the "gay" gander. It's the textbook double standard. It's the near-exact scenario in reverse with a wholly opposite outcome. In one case the government discriminates against the Christian by forcing him, under penalty of law, to violate his right of conscience, while, at the very same time, it allows the "gay" baker to freely exercise his own.

It’s called viewpoint discrimination.

And it’s illegal.

To be clear, I think the commission got it right the second time. Whether "gay" or straight, pagan or Christian, nobody should be forced, against his or her will, to create unique works of art that endorse a message or event that he or she finds repugnant. That sort of thing happens in Communist Russia, not in America.

Yet here we are.

Alliance Defending Freedom Senior Legal Counsel Jeremy Tedesco agrees: "We commend the commission for reaching the right conclusion that these cake artists should not be forced to violate their conscience, but clearly the commission should have done the same for Jack Phillips. The commission found that these three cake artists have the freedom to decline creating unique cake creations because the artists found the requests offensive, but all Americans should be alarmed that the same commission determined that Jack doesn't have that same freedom. Like the other bakers, Jack happily serves all people but declines to use his artistic talents to create cakes that violate his conscience. The commission's inconsistent rulings mean that the owners of these three cake shops may run them according to their beliefs, while Jack cannot. He risks losing his life-long business altogether if he continues to run it consistent with his faith. Such blatant religious discrimination has no place in our society."

Furthermore, and lest we forget, it was the same Christianity secularists now seek to silence that largely led, some time ago, to the abolition of both slavery and indentured servitude.

Why the comeback?

Whereas no “gay” baker in America should be made to slave away for another human being in creation of a product or service that he finds repugnant, neither should a Christian baker be forced to labor in kind.

In short: Bake your own cake.

FCC Is Misleading The Public About The Plan?

On Today’s Broadcast (February 25, 2015): The affordable care Act mandates that people buy health insurance. Complicating matters is the rules and requirements that these policies must provide. Then there's the EPA rules that control everyone's personal property to such a degree that even ditches and storm water culverts are sometimes considered to be waterways. There's also the control over food where the wife of the President has her hand in affecting school lunch menus or government mandated labeling of factors such as calorie content. The airline industry has its intrusive body scans and enhanced pat-downs of passengers.

The latest item that Washington is attempting to add to the list is control over the Internet by treating it as a public utility. Joining Vic to discuss this was James Gattuso. He handles regulatory and telecommunications issues at the Heritage Foundation and is a senior research fellow at the Foundation's Roe Institute for Economic Policy Studies. From 1990-1993 he was the deputy chief at the Federal Communications Commission's office of plans and policy.

Net neutrality refers to the idea that all the content on the Internet should be treated the same way. While on the surface this may sound reasonable, the American marketplace provides varying levels of choice in areas such as technical and pricing option categories and James argues that the Internet should be no different.

While James doesn't see a conscious plan to censor speech or control content via net neutrality legislation, he does believe it sets the stage for that and puts the FCC and the federal government in what he referred to as 'the critical path' for approving what is transmitted via the Internet.

Where does Congress and President Obama stand on this issue? Does the impetus for net neutrality legislation involve purely practical considerations or is there a political element? Is there any merit to FCC Commissioner Ajit Pai's allegation that the FCC is misleading the public about the plan? If these rules stand, what will be the impact on the Internet here in America?
